Defra’s New Hedgerow Regulations – what’s changing?

The Management of Hedgerows (England) Regulations came into effect in May 2024, aimed at protecting hedgerows on agricultural land. Hedgerows are vital: they provide habitat for wildlife, serve as corridors for animal movement, slow soil erosion, and support pollinators. 

Why this matters for farmers and landowners

Hedgerows play a significant role in maintaining biodiversity. Key aspects of the new regulations include:

  • No cutting period: restrictions during specific times to protect nesting birds and other wildlife.
  • Mandatory buffer strips: required spacing to preserve hedgerow habitats.

Proposed approach to regulation

  • Guidance first: farmers, landowners, and others will receive advice and support to help them comply.
  • Sanctions for breaches: while support is prioritised, serious breaches may result in civil or criminal sanctions.

This is an attempt to tell experienced land managers how to do something by folk who haven't a cluie. They think that the only way to force people to do what they are told (right or wrong) is to impose fines and name and shame. A disgrace is what I would call this.

We have to make hedges safe for small birds. As a retired farmer who has cut hedges there is no such thing as one size fits all. We have to consider predators. I have at the moment a pair of sparrow hawks who have decimated my small birds. I would support a 2 to 3 metre high and width which would give small birds a better place to roost.

Where is the regulation to stop farmers trimming hedgerows down to the bare minimum in autumn, removing hedgerow fruit and winter shelter in the process Hedges should be cut no more once than every other year . The standard should be 3.0m high and 3.0m wide with 2.0m wide buffer strips measured from the outside of the hedge, then we might start to see some recovery in our wild bird populations
